1. Acceptance of Terms
By engaging Mainsail’s services, you agree to be bound by the following Terms and Conditions. If you do not agree, you may not use or request our services.
2. Services Provided
Mainsail provides:
Aerial drone photography and videography
- Ground-based videography and editing
- Real estate and commercial content creation
- Post-production and media delivery
Specific deliverables, usage rights, and deadlines will be confirmed in writing prior to each job.
3. Drone Operation & Compliance
Mainsail operates in accordance with New Zealand Civil Aviation Authority (CAA) regulations, including Part 101 and Part 102.
- Clients must ensure necessary permissions are secured for drone filming over private or restricted spaces.
- Mainsail reserves the right to delay or cancel aerial operations due to unsafe weather, legal restrictions, or safety concerns.
4. Client Responsibilities
Clients agree to:
- Provide accurate access and location details.
- Obtain all necessary permissions for filming, including landlord or council approvals if applicable.
- Ensure the filming location is safe, legal, and suitable for operation.
5. Copyright
All raw and final footage is owned by Mainsail unless otherwise agreed in writing.
Upon full payment, the client receives a non-exclusive license to use the final delivered content for the agreed purpose (e.g. property listing, promotional video).
The license does not permit resale or redistribution without prior written consent.
6. Moral Rights
Mainsail retains the moral right to be identified as the creator of any original work.
Clients must not modify, misrepresent, or falsely attribute the work in any way that harms Mainsail’s reputation.
7. Storage and Backups
Delivered footage will be stored for 30 days from the delivery date.
Long-term backups are the client’s responsibility unless a storage extension is agreed upon in writing.
Additional copies or retrievals may incur an administrative fee.
8. Job-Related Costs
Clients are responsible for additional costs related to the job, such as:
- Travel outside of standard zones
- Parking, permits, or council fees
- Special equipment rentals or third-party services (e.g. actors, props)
All job-related costs will be clearly communicated prior to confirmation.
9. Urgent or After-Hours Work
Work requested on short notice (less than 48 hours) or outside standard business hours (8am–6pm, Mon–Fri) may incur a 25% urgency fee.
Acceptance of urgent work is at Mainsail’s discretion and based on availability.
10. Payment Terms
Payment is required in full to secure a booking.
11. Health and Safety
Mainsail follows WorkSafe New Zealand safety protocols.
Filming will not proceed in unsafe conditions, including hazardous weather, unsafe structures, or non-compliant environments.
Clients must inform us of any on-site risks or hazards in advance.
12. Conflicts of Interest
Mainsail will disclose any known conflict of interest prior to accepting a job.
Clients must disclose if content being created relates to competitive, legal, or disputed situations that may affect impartiality or ethical responsibility.
13. Cancellation & Rescheduling
Cancellations within 48 hours of filming may incur a 25% cancellation fee.
Weather-related rescheduling will be accommodated at no extra charge.
Non-refundable costs (e.g., permits, Licenses, accommodation ect) will be billed regardless of cancellation reason.
14. Limitation of Liability
Mainsail is not liable for:
- Loss due to weather, delays, or technical issues
- Regulatory restrictions or denied permits
- Client misuse or alteration of content
Total liability is capped at the amount paid for the service.
15. Privacy and Data Use
Mainsail complies with the New Zealand Privacy Act 2020.
Client data is collected solely for project and communication purposes.
No personal data is shared with third parties without consent.
16. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes shall be resolved under the jurisdiction of New Zealand courts.
17. Updates to Terms
Mainsail reserves the right to update these Terms at any time. The latest version will be made available on our website and applies to all future services.
